Preamble

Nouvelle Cave is a wine and spirits trading company that offers online purchasing through its website “nouvellecave.com“. Please consult our Privacy Policy to learn how we handle the collection of your personal information.

These General Terms and Conditions of Sale (GTC) apply to all orders placed with Nouvelle Cave via its website accessible at the following address: www.nouvellecave.com.

The company reserves the right to modify these terms at any time by publishing a new version on its website. The applicable GTC will be those in the most recent version published at the date of order payment.

Article 1 : Protection of Personal Data

In accordance with the French Data Protection Act of January 6, 1978, you have the right to query, access, modify, oppose, and rectify your personal data. By agreeing to these general terms and conditions of sale, you consent to our collection and use of this data for the execution of this contract. Nouvelle Cave does not sell or rent customer data. Please refer to our Privacy Policy.

Article 2 : Pricing Information

The prices displayed on the website are valid unless there is a clear pricing error.

Product prices shown on the website are indicated in euros, including all taxes (French VAT 20%), but excluding delivery fees. Shipping costs vary depending on the delivery location, and any delivery within France over €300 is free.

Article 3: Orders

To place an order, simply click the “add to cart” button located below the desired product. If you want to add another product to your cart, do the same for all items you wish to purchase. To view your selected products, go to the “cart” tab, then click “proceed to checkout” if you wish to buy. After placing your order, you will receive a confirmation email along with an order number. We will subsequently notify you of the shipment of your items. Invoices will be sent to you by email.

Article 4: Payment Methods

Payment is required immediately and in full at the time of order. You may pay by bank transfer or directly by credit card. According to Law No. 80 336 of May 1, 1980, regarding retention of title, the customer becomes the owner and assumes responsibility for the items upon delivery, with transfer of possession equating to transfer of risk.

Article 5: Delivery Terms

The ordered products are delivered to the delivery address provided when the order is placed. Delivery times depend on the provided address (deliveries outside Europe will take longer than those within France). To ensure prompt delivery, you agree to provide an accurate, complete delivery address and any additional information to facilitate delivery (building number, intercom, door code if necessary). Otherwise, Nouvelle Cave cannot be held responsible for any delivery delays.

You are responsible for checking the condition of the goods upon delivery and for returning the product to the courier if it does not meet your expectations. If you do not make any remarks at the time of delivery, the goods will be considered delivered in perfect condition, and insurance claims will not be possible. In case of partial or total damage during delivery, the customer must check the contents of the package at the time of receipt and send a detailed complaint by registered mail with acknowledgment of receipt to the Seller.

Article 6: Right of Withdrawal

The customer has a period of 14 calendar days from receipt of the order to exercise their right of withdrawal. The customer must inform Nouvelle Cave in writing (by email or postal mail) of their decision before returning the goods, which must be in their original packaging and in strictly identical condition to when they were shipped (the label, wax, fill level, and cork must all be intact as originally sent). Damaged, soiled, or incomplete products will not be accepted for return.

Once the withdrawal has been communicated, the customer has an additional 14 days to return the unwanted products at their own expense. Nouvelle Cave will not cover return shipping costs. Upon receipt of the intact goods, Nouvelle Cave agrees to refund the customer within 15 business days for the amount paid for the wine(s), excluding shipping fees.

Article 7: Intellectual Property Rights

Our brand, domain name, databases, images, texts, logo, or any other information subject to intellectual property rights remain the exclusive property of Nouvelle Cave. No transfer of intellectual property rights is made through these GTC. Any full or partial reproduction, modification, or use of these assets for any reason is strictly prohibited.

Article 8: Purchase and Sale Are Prohibited to Minors

You declare and certify that you are over 18 years old. The sale and purchase of alcohol are prohibited to minors. All our products are reserved for adults, and none of our items may be sold to minors.
